CONTINUATION OF LICENSE
§15-1F-1b. Tolling of the running of any licensure or registration requirement.
The running of any licensure or registration requirement, including, but not limited to, the payment of any license or registration fees of a licensing board or commission of the state shall be tolled during the period of absence for active duty for any member of the National Guard or other reserve component of the armed services of the United States until sixty (60) days after the return of the member from active duty: Provided, That the service member shall be granted a period of time equal to the period of active duty to fulfill any continuing education requirements needed for licensure or registration.
If W. Va. Code § 15-1F-1b applies to you, the West Virginia Board of Medicine would appreciate you providing the following information to avoid expiration of your license.
WAIVER REQUEST
§ 30-1-6b. Licensure…of persons and spouses of persons on military active duty outside this state; extension of licenses…, waiver of certain license… requirements.
(a) During periods when a licensee is on active duty as a member of the Armed Forces of the United States, the National Guard of this State or any other state, or any other military reserve component and deployed outside of this State and for six (6) months after discharge from active duty, the license of a person regulated by this Board shall continue in good standing and shall be renewed without payment of any dues or fees for the maintenance or renewal of the license and without meeting continuing education requirements for the license, when circumstances associated with military duty prevent the individual from obtaining the required continuing education.
(b) The licensee shall submit a waiver request to the Board, informing the Board of circumstances which include, but are not limited to, deployment outside of the United States or in any combat area and verify that the individual performs the licensed profession as part of his or her military duties as annotated in the Report of Separation, Defense Department Form 214 (DD214).
SPOUSE WAIVER REQUEST
(c) During periods when the licensee is accompanying his or her spouse who is on active duty as a member of the Armed Forces of the United States, the National Guard of this State or any other state, or any other military reserve component and deployed outside of this State, and for six (6) months after discharge from active duty, the license of that person regulated by this Board shall continue in good standing and shall be renewed without payment of any dues or fees for the renewal of the license, and without meeting continuing education requirements for the license when circumstances associated with accompanying a spouse on military duty prevent the individual from obtaining the required continuing education.
(d) The licensee shall submit a waiver request to the Board informing the Board of these circumstances which include, but are not limited to, deployment outside of the United States or in any combat area.
