West Virginia State Law, West Virginia Code § 60A-4-410, provides that it is a misdemeanor for a patient, in an attempt to obtain a prescription for a controlled substance, to knowingly withhold from a practitioner, that the patient has obtained a controlled substance prescription of the same or similar therapeutic use in a concurrent time period from another practitioner. The West Virginia Board of Medicine is the sole authority for the issuance of licenses to practice medicine and surgery, to practice podiatry, and to practice as a physician assistant in collaboration with MDs and DPMs in the State of West Virginia, and is the regulatory and disciplinary body for medical doctors, podiatric physicians and their physician assistants.
